Formats we quote for Minnesota

Minnesota sets no format rule. Minneapolis treats kratom as an unapproved food additive for food and beverage retailers, so gummies and shots carry extra caution, but we quote all six formats.

How a Minnesota order works

  1. Send your business details, products, quantities and every Minnesota ship-to address through the quote form.

  2. We check each address against Minn. Stat. 152.027 and any local rules we know about, and tell you if anything needs to change before we quote.

  3. We quote the order. Pricing is not published and there is no online checkout.

  4. The manufacturer ships direct to you, with the lot's lab report available for the products you ordered.

Minnesota order checklist

Five things to settle before you place a Minnesota order, in the order they usually come up.

Move every age gate to 21

Since August 1, 2026 a sale to anyone under 21 is a gross misdemeanor. Update staff training, signs and register prompts that still say 18, and confirm ID for every counter sale.

Go by the session law

The Revisor online statute page still shows 18 with a note about the 2026 amendment. Laws of Minnesota 2026, chapter 63 is the controlling text until the codified page updates.

Decide where gummies and shots are sold

Minneapolis lists kratom as an unapproved food additive for food and beverage retailers. If your site operates under a food or beverage license, ask the city before stocking edibles or liquids.

Describe products plainly

Selling kratom as a food, drug or supplement can bring general law into play, and which state agency would act was not settled in the sources we reviewed. Keep claims off the label and the shelf.

Keep 7-OH and mitragynine reports by lot

The federal DEA notice uses numeric thresholds. A lot report is how you compare each product to them, and the file is easy to hand to a county attorney or a buyer.

Minnesota compliance points for buyers

Age is the whole state law

Minn. Stat. 152.027, subd. 7 makes it a gross misdemeanor to sell kratom, or any product with mitragynine or 7-OH, to someone under the age limit. Laws of Minnesota 2026, chapter 63 raised that limit from 18 to 21 on August 1, 2026.

Old signs may still say 18

The Revisor online statute page still shows 18 with a note about the 2026 amendment. Go by the session law, and update staff training, signs and checkout age gates that still say 18.

Why we flag gummies and shots

Minneapolis lists kratom as an unapproved food additive for food and beverage retailers, and our research did not settle which state agency would act on edibles. No statute bars gummies or shots, so we quote them, and we suggest checking with local officials.

Federal action and 2027 bills

Mitragynine pseudoindoxyl, MGM-15 and MGM-16 are federal Schedule I as of August 26, 2026, and DEA published a 7-OH notice of intent on October 14, 2026. A Minnesota lawmaker has said she plans 2027 bills on labeling, licensing and where kratom can be sold.

Labels and records for Minnesota

What the statute asks for on a package, and the records that let you stand behind it.

No state label requirement

The Public Health Law Center and MPR News both report that Minnesota has no kratom labeling requirement. Plain, accurate labels remain your best protection under general food and supplement law.

An age notice at the point of sale

Because the penalty attaches to the sale, many stores post the 21 rule at the register and log training dates. Keep that paper with your lot reports and invoices.

Local rules inside Minnesota

Minneapolis. Lists kratom as an unapproved food additive for food and beverage retailers and otherwise does not regulate it. As of June 2026 no Minnesota city or county was known to restrict kratom sales, but local governments can adopt stricter rules, so we review every ship-to address.

Minnesota compared with nearby states

South Dakota

A regulated product market: the 7-OH cap is 2% of alkaloid composition, which Minnesota does not have.

Montana

No state law at all and no age limit, with a statewide ban draft headed to the 2027 Legislature.

Illinois

A lower state age: 18 under the Kratom Control Act, with 21 only in pending bills and some cities targeting 7-OH.
