Short answer
Yes, today. Montana has no kratom-specific law as of October 18, 2026: no state age limit, label rule, testing rule or license. That may not last. In August 2026 an interim committee voted 6-5 to advance a statewide ban draft for the 2027 Legislature, while a regulation draft was tabled 8-1. Kratom. One quotes six formats to Montana businesses and ships direct from US manufacturers.
Montana at a glance
The short version of what applies to a Montana order. Full rules are on our Montana law page.
Formats we quote for Montana
Montana has no format rules today. The open question is the 2027 ban draft, which could reach every format.
Leaf powder for Montana buyers
Plain leaf powder faces no Montana label or testing rule. If the 2027 draft passes as a ban on kratom compounds it could reach leaf too, so keep stock plans short.

Red Maeng Da

Green Maeng Da

White Maeng Da

Red Bali

Green Malay

White Borneo
Crushed leaf for Montana buyers
Same position as powder. No state rule applies now, and the draft's reach over natural leaf has not been confirmed.

Crushed Kratom Leaf
Capsules for Montana buyers
Capsules carry no state-specific rule. A lot report that shows mitragynine and 7-OH lets you compare each product to the federal threshold.

Red Vein Capsules

Green Vein Capsules

White Vein Capsules
Extracts for Montana buyers
We quote extracts against a lot report only. Concentrated and synthesized 7-OH products drew the most concern at the interim hearings, and we do not ship concentrated or isolated 7-OH products into Montana.

Kratom Extract Powder

Liquid Kratom Extract

Mitragynine Extract

High Purity Mitragynine
Gummies for Montana buyers
No Montana edible rule exists. A tabled consumer-protection draft would have required labels and testing, so clean, accurate packaging is the sensible baseline.

Mixed Berry Gummies

Tropical Gummies

Watermelon Gummies
Shots for Montana buyers
Montana has no state rule for liquid shots today. Because the pending DEA notice measures liquids per milliliter, ask for lot-level alkaloid data on any shot order.

Montana order checklist
Five things to settle before you place a Montana order, in the order they usually come up.
Keep inventory and contracts short
A statewide ban draft is headed to the 70th Legislature in January 2027, and whether it covers natural leaf is unconfirmed. Avoid long supply commitments or large forward stock until the session outcome is clear.
Choose a 21 counter policy
Montana sets no age, and the tabled draft would have set 18. Some legislators pushed for 21 during that review, and 21 is our own rule, so a 21 gate is the safest policy to adopt now.
Avoid synthesized and concentrated 7-OH
These products drew the most concern in the interim hearings. Keep them off the order, and file the lot report for any extract you do stock.
Track which draft moves
There are two competing tracks: a ban draft that advanced 6-5 and a regulation draft that was tabled 8-1. Ask us to recheck Montana when bill numbers and text are published.
Check town and county code
We found no Montana city or county kratom ordinance, but local rules were not searched in depth. Send every ship-to address so we can review it.
Montana compliance points for buyers
No state kratom law
Montana has no statute or rule written for kratom or 7-OH, so no state age limit, label content, testing, alkaloid cap or seller license applies. That finding rests on consistent news reports, and a primary search of the Montana code did not separately confirm it.
The 2027 ban draft
In late August 2026 the Economic Affairs Interim Committee voted 6-5 to advance a draft that would prohibit kratom by making its compounds controlled substances. The draft text was not available, and it is unclear whether it reaches natural leaf. The 2027 Legislature must still pass it.
The tabled regulation draft
On September 1, 2026 the Law and Justice Interim Committee tabled a Kratom Consumer Protection Act draft by 8-1. It would have set labels, testing and an 18+ age limit, and some members pushed for 21.
Federal scheduling
Mitragynine pseudoindoxyl, MGM-15 and MGM-16 have been temporary Schedule I substances since August 26, 2026. DEA’s October 14, 2026 notice on 7-OH cannot lead to an order before November 13, 2026. Whether Montana’s schedules will follow is not known.
Labels and records for Montana
What the statute asks for on a package, and the records that let you stand behind it.
No label mandate today
With no Montana kratom statute there is no required label content. Use accurate names, net quantities and ingredient statements, and keep claims about effects off the package.
Lot data for a possible testing law
The tabled draft would have added state oversight and testing. Buyers who already file lot reports showing mitragynine and 7-OH by delivery will be ready if testing arrives in 2027.
What changed and what to watch
- Late August 2026

Montana compared with nearby states
Idaho
Also no state kratom law, but every 2026 bill failed there, including a regulation bill that lost 15-20 in the Senate, with no committee-approved ban draft.
Wyoming
A settled regulated market: a 2% 7-OH cap under W.S. 35-7-2201 to 2203 since July 1, 2026, and gummies are not listed.
South Dakota
A statute already in place: the 7-OH cap is 2% of alkaloid composition.

Why does Kratom. One use 21 when Montana has no age limit?
Montana sets no statewide age. We sell to adults 21 and over only, which keeps one rule across every state we serve.

We could not confirm it. The draft would make kratom compounds controlled substances, but its text and bill number were not available, so whether it reaches plain leaf or only alkaloids such as 7-OH is unknown.
