Federal update

Kratom and 7-OH

Kratom (Mitragyna speciosa) is a botanical. Botanical kratom is not federally scheduled in the United States. In 2026 the DEA moved to temporarily place 7-hydroxymitragynine (7-OH) above a specified threshold, and related compounds, in Schedule I; that action does not cover botanical kratom with naturally occurring 7-OH below the threshold. Kratom. One does not sell 7-OH, MGM-15, or enhanced or concentrated 7-OH products. Federal, state and local rules for kratom are changing, and we update our listings as they do. Each buyer is responsible for knowing and following the rules that apply to its own business.

For B2B clients

All products listed on Kratom. One are intended solely for sale and distribution to businesses involved in the manufacture, distribution and resale of kratom products. Every manufacturer, wholesaler, distributor and retailer is responsible for making sure these products are not sold to or used by anyone under 21, or any higher age set by state or local law. Business clients are responsible for making sure all product labels meet legal requirements and carry the warnings, statements and registrations their jurisdictions require.

FDA status

The FDA has not approved kratom for any use. The FDA has taken the position that kratom is not lawfully marketed as a dietary supplement or as a food or beverage ingredient, and it maintains an import alert covering kratom. These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure or prevent any disease. B2B clients must make sure their marketing, labeling and sales practices comply with FDA requirements and must not make disease, drug or unsupported health claims.

State and local law

Several states, counties and cities ban or restrict kratom. Other states have adopted kratom consumer protection laws that set age limits, labeling, testing, registration or product standards. It is the responsibility of B2B clients to know and comply with every federal, state and local law that applies to the purchase, possession, labeling, marketing and resale of kratom products where they operate and where they sell.

For consumers

Kratom. One does not sell to consumers. Finished products made by our business clients should be used only as their labels direct and are not intended for anyone under 21, or for anyone who is pregnant or nursing. Consumers should consult a physician before use, particularly if they have a medical condition or take prescription medication.

Drug testing and safety

  • Some drug tests can detect kratom alkaloids. B2B clients should communicate this in their product documentation.
  • Keep products out of reach of children and pets, and store in a cool, dry place away from light.
  • Do not combine kratom products with alcohol, drugs or other substances, and follow all label warnings. B2B clients should state safety guidance on packaging and materials.

Medical and usage disclosures

The information on Kratom. One is for general information only and is not medical advice. We do not give directions for use or dosing guidance. Kratom. One is not responsible for improper use of products or for claims made by others about them.

Terms and Conditions

Overview

This website is operated by Kratom. One, which sells products as agent for licensed manufacturers, as described in Section 46. Throughout the site, “we”, “us” and “our” refer to Kratom. One, and “Buyer” or “you” refers to the business placing, approving or paying for an order and the person acting for it. We offer this website, including all information, tools and services available from it, on the condition that you accept all terms, conditions, policies and notices stated here.

By visiting the site, requesting a quote or purchasing from us, you use our “Service” and agree to be bound by these terms (“Terms”), including the policies referenced on this page. These Terms apply to all users of the site, including browsers, vendors, customers, merchants and contributors of content. If you do not agree to all of the Terms, you may not use the website or the Service. We may update, change or replace any part of these Terms by posting changes to this page, and continued use after changes are posted is acceptance of them. Our store is hosted on WordPress and WooCommerce.

Section 1. Online store terms

By agreeing to these Terms, you represent that you are at least 21 years old and that you are ordering for a business. You may not use our products for any illegal or unauthorized purpose or violate any law in your jurisdiction. You must not transmit any worms, viruses or code of a destructive nature. A breach of any of these Terms results in immediate termination of your Services.

Section 2. General conditions

We may refuse service to anyone for any reason at any time. Your content, excluding card information, may be transferred unencrypted and may involve transmission over various networks. Card information is always encrypted in transfer. You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service without our express written permission.

Section 3. Accuracy, completeness and timeliness of information

We are not responsible if information on this site is not accurate, complete or current. The material is provided for general information only and should not be the sole basis for decisions. Any reliance on it is at your own risk. We may modify the contents of this site at any time but have no obligation to update any information.

Section 4. Modifications to the Service and prices

Prices are subject to change without notice until an order is confirmed in writing. We may modify or discontinue the Service, or any part of it, without notice at any time, and we are not liable to you or any third party for any modification, price change, suspension or discontinuance.

Section 5. Products

Some products may have limited quantities and are subject to return or exchange only under our Return Policy. We try to display product colors and images accurately but cannot guarantee your display. We may limit sales of any product to any person, business, region or jurisdiction and may limit quantities. Product descriptions and pricing are subject to change. Quantitative amounts are approximate, and alkaloid content varies naturally from lot to lot; the batch lab results for your lot are the specification. We do not provide dosing guidance or directions for use, and nothing on this site is an instruction on how to use any product.

Section 6. Accuracy of billing and account information

We may refuse any order. We may limit or cancel quantities per person, business or order, including orders under the same account, card or billing or shipping address. We may try to notify you of a change or cancellation using the contact information on the order. You agree to provide current, complete and accurate purchase and account information and to keep it updated.

Section 7. Optional tools

We may provide access to third-party tools that we neither monitor nor control. They are provided “as is” and “as available” without warranty or endorsement, and your use of them is at your own risk.

Section 8. Third-party links

Some content, products and services on the Service may include third-party materials or link to sites not affiliated with us. We are not responsible for and are not liable for any third-party materials, websites, products or services. Review the third party’s policies before any transaction.

Section 9. Comments, feedback and submissions

If you send us submissions, whether at our request or not (“comments”), we may edit, copy, publish, distribute and otherwise use them in any medium without restriction, confidentiality, compensation or a duty to respond. You agree your comments will not violate any third-party right and will not contain unlawful, abusive or obscene material or malware. You are solely responsible for your comments.

Section 10. Personal information

Your submission of personal information is governed by our Privacy Policy.

Section 11. Errors, inaccuracies and omissions

Information on the site may contain typographical errors, inaccuracies or omissions relating to product descriptions, specifications, pricing, promotions, shipping charges, transit times and availability. We may correct errors, update information or cancel orders if any information is inaccurate, at any time and without prior notice, including after you submit an order.

Section 12. Prohibited uses

You may not use the site or its content: for any unlawful purpose; to solicit others to act unlawfully; to violate any law or regulation; to infringe intellectual property rights; to harass, abuse or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect or track the personal information of others; to spam, phish or scrape; for any obscene or immoral purpose; or to interfere with the security of the Service. We may terminate your use of the Service for any prohibited use.

Section 13. Disclaimer of warranties and limitation of liability

We do not guarantee that the Service will be uninterrupted, timely, secure or error-free. Your use of the Service is at your sole risk. The Service and all products delivered through it are provided “as is” and “as available” without representation or warranty of any kind, except the Manufacturer’s limited warranty that we pass through under Section 44. In no case shall Kratom. One or its owners, directors, officers, employees, affiliates, agents, contractors, suppliers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages, including lost profits, revenue or data, arising from your use of the Service or any product. Where a jurisdiction does not allow these limitations, our liability is limited to the maximum extent permitted by law, and Section 28 applies.

Section 14. Indemnification

You agree to indemnify, defend and hold harmless Kratom. One and our owners, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your resale of our products.

Buyer indemnity. To the fullest extent permitted by law, the Buyer will also indemnify, defend and hold harmless Kratom. One, its affiliates, successors and assigns, and its payment processors and financial institutions, from all claims, liabilities, damages, losses, expenses, demands and suits, including reasonable attorneys’ fees, arising out of or related to: (a) the misuse, mislabeling, improper handling, repackaging or modification of products by the Buyer or its agents, employees, contractors or customers; (b) the Buyer’s failure to comply with any federal, state or local law related to the purchase, possession, resale, distribution, labeling or marketing of the products, including kratom-specific laws; (c) third-party claims arising from the Buyer’s business practices, distribution, advertising or representations about the products; (d) payment-related claims, including fraudulent transactions, chargebacks and disputes; and (e) any breach of the Buyer’s representations, warranties or obligations. The Buyer will promptly notify us of any claim and cooperate in its defense. We may assume the exclusive defense of any matter at our own expense. This indemnity survives termination.

Section 15. Severability

If any provision of these Terms is found unlawful, void or unenforceable, it is enforced to the fullest extent permitted by law and the unenforceable part is severed without affecting the remaining provisions.

Section 16. Termination

Obligations and liabilities incurred before termination survive it. These Terms are effective until terminated by you or us. You may terminate them by telling us you no longer wish to use the Service. If we suspect you have failed to comply with any provision, we may terminate this agreement at any time without notice, and you remain liable for all amounts due up to the date of termination.

Section 17. Entire agreement

Our failure to exercise or enforce any right is not a waiver. These Terms, the policies on this page and the Manufacturer product terms under Section 48 are the entire agreement between you and us and supersede any prior agreements. Ambiguities are not construed against the drafting party.

Section 18. Governing law

These Terms and any separate agreements under which we provide the Service are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Denver, Colorado for any dispute not subject to arbitration under Section 41.

Section 19. Changes to these Terms

You can review the current version of these Terms on this page at any time. We may update, change or replace any part of them by posting changes here, and continued use of the website after changes are posted is acceptance of them.

Section 20. Contact information

Questions about these Terms can be sent through our contact page or by replying to your order confirmation email.

Section 21. Cancellations

Cancellations are not guaranteed and are governed by our Cancellation Policy and Section 43.

Section 22. Shipping and risk of loss

See our Shipping Policy for expectations about your order’s arrival.

Shipment and risk of loss. All sales ship FOB the shipping facility (origin), whether that facility is ours or a Manufacturer’s. Title passes from the Manufacturer to the Buyer, and all risk of loss, damage, delay, theft, misdelivery and Government Action (Section 24) passes to the Buyer, when the products are handed to the carrier, even if freight is prepaid, quoted or discounted and even if we arranged the carrier. The carrier acts as the Buyer’s agent for delivery.

Carrier claims and insurance. We do not insure shipments unless the Buyer accepts shipping insurance under Section 32 and pays for it before shipment. The Buyer is responsible for filing and pursuing every carrier claim. Any help we give is a courtesy and does not change who bears the risk.

Carrier and service choices. If the Buyer asks for a specific carrier, service level, consolidation, freight forwarder or delivery instruction, the Buyer accepts every risk of that choice, including carrier restrictions on kratom products. We may choose a different carrier or service where we believe it is safer or more lawful and may decline to ship with any carrier.

Exceptions. The only exceptions to this Section are the transit-claim process in the Shipping Policy for insured shipments and loss, shortage or damage we confirm in writing. That process does not apply to Government Action.

Section 23. Orders, payment and disputes

  • Order acceptance. An order is accepted only when we confirm it in writing. The automatic email sent when an order is placed confirms receipt only. It is not an invoice or our acceptance. For quoted and invoiced orders, you accept these Terms and the order details by signing or replying to approve our quote or order confirmation before payment.
  • Payment. Payment is due in full before an order ships, by the payment methods listed on your quote or invoice. Any card or processing fee is shown on the invoice before you pay. We may require wire transfer for first orders from new accounts and may offer other methods to accounts with an established order history, at our discretion. For products we sell as agent, we collect payment on the Manufacturer’s behalf, and payment to us fully satisfies the Buyer’s payment obligation to the Manufacturer for that order. Invoices are issued in our name and state that we sell as agent for a licensed manufacturer identified by our code.
  • Verification. We may require verification before we accept, charge or ship an order, including business registration, a sales tax license, a resale certificate, a photo ID of the person ordering, a photo of the card with all but the last four digits covered, and a short video call. We use verification documents only to verify the order and delete card and ID images once verification is complete.
  • Payment disputes and chargebacks. If there is a problem with your order, you agree to contact us first through our contact page or by replying to your order confirmation, and to give us 10 business days to resolve it before filing a chargeback or payment dispute. Filing a dispute without contacting us first, or disputing an order delivered as described, is a breach of these Terms. You then remain responsible for the full order amount plus dispute, bank and processing fees and reasonable collection costs, and we may close your account. We keep order records, written approvals, communications, shipping and delivery records and batch lab results and provide them to the card issuer in response to any dispute. See also Sections 26 and 33.

Section 24. Seizure, detention and Government Action

Government Action. “Government Action” means any seizure, confiscation, forfeiture, detention, hold, inspection, testing, quarantine, embargo, rejection, destruction, delay, return-to-sender or refusal to carry or deliver any shipment or part of it, by a carrier, postal service, customs or border authority, or any federal, state, local, tribal or foreign government or law enforcement agency, and any carrier decision to refuse, suspend or cancel service for kratom products or for the Buyer. It applies before or after any delivery attempt, whether or not the products are lawful where shipped, and whether the action is based on the products, the Buyer, the address, the route, a mistake or a change in law or policy.

Buyer bears all risk. The Buyer bears all risk, loss and cost of any Government Action. Government Action is not a defect, shortage, nonconformity, breach or lost-in-transit event under any of our policies and is not a failure of delivery by us.

No refund, credit, replacement or other remedy. Once a shipment leaves the origin facility, we owe no refund, credit, replacement, reshipment, price reduction or compensation of any kind for Government Action. The Buyer remains liable for the full order price, freight and any fees, fines, storage or costs charged by a carrier or authority.

Waiver. To the fullest extent permitted by law, the Buyer waives and releases any claim against us, our owners, affiliates, suppliers and carriers for loss arising from Government Action, including lost profit, lost resale, business interruption and liability to its own customers. The Buyer will not file a chargeback or payment dispute over Government Action; if it does, Section 23 applies.

Notice and cooperation. The Buyer will tell us within 2 business days of learning of any Government Action and give us every notice, tracking record and communication it receives. The Buyer will not speak for us or make statements about the products’ legality on our behalf. We may cooperate with any lawful request or order, including by sharing order, shipping, payment and lab records, without liability to the Buyer.

Indemnity. The Buyer will indemnify us for losses, costs, fines and reasonable attorneys’ fees we incur because of Government Action connected to the Buyer’s order, to the extent the Buyer’s act, omission, address, license status or misstatement caused or contributed to it.

No reshipment obligation. We may decide, in writing and at our sole discretion, to reship. Any reshipment is a new order at the Buyer’s cost and does not waive this Section or admit fault.

Self-arranged shipping. If the Buyer uses its own carrier account, label or freight forwarder, our responsibility ends when the carrier takes the shipment. Any help we give to recover a lost or seized shipment is a courtesy that creates no duty to refund or replace.

Acknowledgment and survival. The Buyer acknowledges that carriers and authorities may restrict or seize kratom products without notice, that we have disclosed this risk, and that our pricing reflects this allocation. This Section survives completion, cancellation or termination of any order.

Section 25. Buyer compliance and destination responsibility

Representations and warranties. By placing, approving or paying for any order, the Buyer represents and warrants, on the order date and again at shipment, that: (a) it is a business and the person ordering is at least 21 and has authority to bind it; (b) it holds every license, registration, tax permit and approval required to buy, possess, store and resell the products where it operates and at the ship-to address; (c) the products are lawful to possess and sell at the ship-to address and in every jurisdiction through which they will travel; (d) it will not sell to anyone under 21, or any higher legal age, or to consumers where that is prohibited; (e) all order, identity, address, license and payment information it gives us is true, complete and current; and (f) it is not buying for an undisclosed third party, for export or transshipment, or for any unlawful purpose.

Destination responsibility. The Buyer alone decides whether a product may lawfully ship to, be possessed in and be sold in its destination. We may rely on the Buyer’s representations and need not investigate. Our ship-to review is a risk control for our own business, not legal advice. Our acceptance of an order, our shipping to an address, or any lab result, listing or sales statement is not a statement or guarantee that a product is lawful, deliverable or compliant at the destination.

Verification and records. We may require licenses, tax certificates, business registration, ID and a video call before or after we accept or ship an order. We are not required to verify any license and do not warrant that any license is valid or sufficient. We may keep and share business and shipping records with payment processors, carriers and authorities where required or reasonably needed to defend a claim. Refusing to provide requested information lets us cancel or hold the order.

Right to refuse, hold or cancel. We may refuse, hold, limit or cancel any order, or stop shipping to any state, address or Buyer, at any time and for any reason, including a good-faith belief that shipping would be unlawful, unsafe or likely to be subject to Government Action. If we cancel before shipping and the Buyer has paid, our only obligation is to refund the amount paid, less wire, card or processing fees.

No international orders. We ship within the United States only. We do not export kratom products, and the Buyer must not export or transship products bought from us.

Changed destinations. The Buyer must not redirect, reroute or forward a shipment to a destination other than the one on the order without our written approval. If it does, Section 24 applies in full.

Section 26. Final sale after shipment, chargebacks and refund limits

Final sale after shipment. Once an order ships, it is a final sale. Our only obligations after shipment are (a) a replacement, credit or refund for a quality or weight claim we confirm in writing under the Return Policy, and (b) a replacement, credit or refund for transit loss, shortage or damage we confirm in writing under the Shipping Policy. Neither applies to Government Action, Buyer error, a change of mind, or the Buyer’s inability to resell, label or sell the products.

Sole and exclusive remedy. Where we owe a remedy, it is limited to replacement, credit or refund of the price of the affected products, at our option, and does not include freight, storage, lost profits, resale value or the Buyer’s costs.

How product claims are handled. The Buyer brings every product claim to us, not to the Manufacturer. We present confirmed quality and weight claims to the Manufacturer and manage the outcome with the Buyer. For products we sell as agent, product defects are the Manufacturer’s responsibility, and our liability for them is limited to delivering the remedy in this Section. We remain responsible for our own services, such as order handling and payment collection, subject to Section 28.

Tracking and records are conclusive. Carrier tracking or delivery records showing delivery to the address on the order, or showing a hold, seizure, refusal or return, are conclusive proof of delivery or of the event shown unless the Buyer proves otherwise within the claim period.

Chargebacks. A chargeback or payment dispute over a shipment delivered as shown by tracking, or subject to Government Action, is a breach of these Terms. The Buyer authorizes us to give these Terms, its approvals, tracking, delivery, verification and lab records to the card issuer, bank or processor, and is liable for dispute and bank fees, reasonable collection costs and attorneys’ fees, and any amount we cannot recover.

Account consequences, set-off and collection. After a breach of this Section we may suspend or close the account, refuse future orders, require wire prepayment and report unpaid amounts. We may set off amounts owed against credits, refunds or future orders. Overdue balances bear interest at the lower of 1.5% per month or the legal maximum, plus reasonable collection costs and attorneys’ fees.

No waiver by goodwill. Any refund, credit or reshipment given as a courtesy is a one-time accommodation and does not change these Terms.

Section 27. Regulatory change, resale and warranties

Regulatory change. Kratom laws are changing, including the DEA’s temporary scheduling of 7-OH, FDA enforcement, state and local bans and state kratom consumer protection laws, and enforcement priorities can change without notice. We may, without liability, cancel, suspend, reprice, substitute or modify any order, product, listing or shipping method, or stop shipping to any location or Buyer, if we believe in good faith that continuing would violate law or create enforcement, carrier or payment-processor risk. If we cancel an unshipped order for this reason, our sole obligation is to refund the amount paid for it. Products already shipped are governed by Section 24.

Resale and downstream use. The Buyer is solely responsible for how it tests, labels, formulates, packages, markets, sells and distributes the products and for its customers’ use of them. Products are sold to businesses for resale or further manufacture, not for personal consumption. The Buyer will not make disease, drug or unsupported health claims; will not sell to anyone it knows or should know is under 21 or will use the products unlawfully; will meet every state and local labeling, age, testing and registration requirement; will keep records sufficient to trace its sales; and will pass on all required warnings. The Manufacturer is responsible for each finished product’s label as the Manufacturer shipped it, including any state kratom labeling, age-limit and warning requirements, and the Buyer is responsible for the labeling, registration and compliance of anything it makes, relabels or resells.

Private label. For unbranded and private label products, the Buyer is the brand owner and is solely responsible for its label, artwork, claims, warnings, registrations and compliance in every market where it sells.

Regulatory inquiries. If any authority contacts either party about the Buyer’s order, the Buyer will not state or imply that we guaranteed legality, compliance or deliverability, and will tell us within 2 business days where the law allows.

Product as described; disclaimer of warranties. The batch lab results for the lot are the specification. Neither we nor the Manufacturer make any other warranty. We make no warranty of merchantability, fitness for a particular purpose, legality or regulatory status in any jurisdiction, and no warranty that a product can be sold or shipped anywhere, to the fullest extent permitted by law. No statement by our staff or on our site creates a warranty or guarantee.

Samples and special orders. Samples, test lots, custom, private label and special-order products are final sale from shipment, are not returnable and are subject to Sections 22 to 48.

Section 28. Limits on liability and force majeure

Liability cap. Our total liability for any claim arising from or related to an order, our products, our site or these Terms is limited to the greater of $500 or the amount the Buyer actually paid for the products giving rise to the claim, excluding shipping and fees. The cap applies to every legal theory and survives termination. We are never liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost revenue, lost resale, loss of goodwill or business interruption.

Force majeure. We are not liable for failure or delay caused by events outside our reasonable control, including carrier disruption, Government Action, new or changed laws or enforcement, seizure or embargo, supplier, lab or manufacturing delay, natural disaster, pandemic, cyber incident, or bank or payment-processor restrictions. We may cancel affected orders and refund unshipped amounts.

Section 29. Claim deadline and waiver

Any claim against us must be made in writing, with the documents these Terms require, within 30 days of the delivery date (or the date delivery was due), or it is waived, except where the law requires a longer period. Shorter notice windows in the Shipping Policy and Return Policy apply to those claims. A claim must be filed as an arbitration or lawsuit within one year after it accrues, to the extent the law allows.

Section 30. Notices, records and general provisions

Notices and electronic records. Email to the address on the order, our confirmation emails, and tracking and carrier records are valid notices and evidence. The Buyer consents to electronic signature and electronic delivery of notices, and a reply or payment is acceptance of an order confirmation.

No assignment; no oral changes. The Buyer may not assign its rights or obligations under any order without our written consent. These Terms, the policies on this page, the Manufacturer product terms under Section 48 and a signed or emailed order confirmation are the whole agreement. Statements by sales staff, quotes, calls, chats and website or marketing material do not change these Terms unless an authorized owner of Kratom. One confirms the change in a signed writing.

Survival. Sections 22 to 48, the indemnities, the liability cap and the payment and chargeback terms survive completion, cancellation or termination of any order.

Affiliates and agents. Every protection in these Terms also applies to our owners, affiliates, officers, employees, agents, suppliers and service providers, who may enforce it.

Section 31. Dispute resolution

The parties will first try in good faith to resolve any dispute informally for 30 days after written notice. Any claim must be brought in the Buyer’s own name only, not as a class, collective or representative action. The prevailing party recovers reasonable attorneys’ fees and costs. Each party waives jury trial to the extent the law allows. Unresolved disputes go to binding individual arbitration under Section 41, subject to its carve-outs, and Section 18 governs everything else.

Section 32. Optional shipping insurance

At checkout, on each quote or on each invoice we offer shipping insurance for the order at the fee shown, currently 3% of the order’s product value. The Buyer must accept or decline in writing (checkbox or email) before shipment. If the Buyer declines, or we have not received payment for insurance before shipment, the Buyer waives all insurance coverage and bears all risk of loss or damage in transit. The Shipping Policy’s transit-claim process for loss and damage applies only to insured shipments and to errors we confirm in writing. If the Buyer accepts, the carrier’s or insurer’s terms control and coverage is limited to them. Insurance commonly excludes Government Action and restricted items, the fee is non-refundable once shipped, and insurance does not change Section 24.

Section 33. Chargebacks and fraud

Canceling a payment, reversing a wire or ACH, or filing a chargeback or payment dispute after an order has shipped is a breach of these Terms and may be treated as fraud, other than a good-faith dispute made after the notice and 10 business days required by Section 23. We may suspend or close the account and related accounts, require wire prepayment, pursue collection and report the matter to our payment processor, bank and carriers and, where the law allows, to fraud-prevention services and authorities. The Buyer consents to that reporting. If any payment is reversed or disputed, we may hold or cancel pending orders, set off the amount against credits and recover all related fees and costs.

Section 34. Order verification and holds

We may verify any order or account before accepting, charging or shipping it, including new accounts, higher-value orders and orders to new addresses. If we ask for information and the Buyer does not respond fully within 48 hours of our last attempt, we may cancel the order and refund the amount paid, less wire, card and processing fees. A held order does not obligate us to ship, and hold time does not extend or breach any delivery estimate.

Section 35. Undeliverable and restricted addresses

We ship to the verified business address on the order, or to another address the Buyer designates in writing and we approve. We do not ship to PO boxes, parcel lockers, freight forwarders (unless we approve in writing) or APO, FPO and DPO military addresses. An order to such an address, or to an address we cannot verify, may be held or canceled and refunded less fees, and we may restrict the account. We are not liable for any resulting delay, cost or Government Action.

Section 36. Restricted locations

We may decline to ship any product to any state, locality or address at any time and may change the locations we serve without notice. Any list of places we serve or do not serve, and any message at checkout, is a convenience only. It may be out of date and is not a statement that a product is lawful in a place we ship to or unlawful in a place we do not list. Our shipping to a location is not approval of any sale there. The Buyer must tell us before ordering if it knows a product is restricted at the destination or anywhere it will resell.

Section 37. State-specific buyer certifications

At checkout, on each quote or invoice approval, and in the order confirmation, the Buyer must confirm for the ship-to state, by checkbox, signature or written reply, that: (a) it is a business buying for resale or further manufacture and not for personal consumption; (b) the person ordering is 21 or older; (c) it holds every license, permit and registration the ship-to state and locality require to buy, possess and resell these products and will give us copies on request; (d) the products it ordered are lawful to possess and resell as it sells them there; and (e) it has read any state notice we show. For states we flag, we may require added certifications, a license upload or a verification call before shipping. We record the date, time, account and confirmation with each order. Each certification is a representation under Section 25 and is repeated for every order. A false, incomplete or outdated certification is a breach and entitles us to indemnity under Sections 14 and 24.

Section 38. Taxes and resale certificates

We sell only to businesses for resale or further manufacture, and prices exclude taxes. Our not charging tax on an order is not a determination that the sale is exempt. We treat an order as exempt when the Buyer has given us a valid resale or exemption certificate for the ship-to state, issued to Kratom. One, and we have accepted it. We accept and keep certificates for ourselves and on behalf of the Manufacturer. The Buyer warrants that each certificate is valid, complete and accurate and will update it on request. Do not send us a Social Security number; use an EIN or state tax ID. If no valid certificate is on file, or a taxing authority rejects one, we may charge tax even after shipment, and the Buyer pays any tax, interest, penalties and fees assessed on us because of its order. The Buyer is solely responsible for all taxes, duties and license fees on its purchases and resales, including use tax.

Section 39. Account security and authorized users

The Buyer is responsible for all activity under its account, email address and order approvals, including by employees and contractors. The Buyer will keep its credentials secure and tell us at once of any unauthorized use. We may rely on instructions from anyone using the account credentials or the contact email on file and may refuse to change an address, payment method or contact detail without verification.

Section 40. Recorded communications and our discretion

The Buyer consents to our recording and keeping calls, video verification calls, chats and other communications and to our using them as evidence. Where these Terms let us decide whether to accept, hold, cancel or refuse an order or account, whether we suspect fraud or non-compliance, or whether a claim is valid, we decide in our sole good-faith discretion, and our decision is conclusive absent manifest error.

Section 41. Binding individual arbitration

After the 30-day informal period in Section 31, any dispute arising out of or relating to these Terms, any order or the products will be resolved by final and binding arbitration before one arbitrator administered by the American Arbitration Association under its Commercial Arbitration Rules, including its Expedited Procedures where they apply. Hearings are held remotely by video unless the arbitrator orders otherwise. The Federal Arbitration Act governs this Section, and Section 18 governs everything else. Judgment on the award may be entered in any court with jurisdiction. Claims may be brought only individually, not as a class, collective or representative action. Each party pays the fees the AAA rules assign to it, and the arbitrator may award the prevailing party its fees, costs and attorneys’ fees. Carve-outs: either party may go to Denver state or federal court, or small claims court, to (a) collect unpaid amounts and (b) seek injunctive relief to protect intellectual property or confidential information. The arbitration is confidential except as needed to enforce an award or as the law requires. If the class waiver is found unenforceable, the class claim proceeds in court, not arbitration.

Section 42. Confidentiality and non-circumvention

“Confidential Information” means our pricing, quotes and terms; the identities and contact details of our suppliers, growers, processors, manufacturers and labs; Manufacturer codes, unredacted documents, and any lot number, packaging detail or label information that could identify a Manufacturer; non-public lab results, formulations and specifications; our customer lists; and the terms of any agreement with us. The Buyer will use Confidential Information only to complete its own purchases and resale of our products, share it only with employees and advisers who need it and are bound to keep it confidential, and protect it with at least reasonable care. The Buyer will not try to remove, reverse or work around any redaction, or use lot numbers, packaging, labels or lab report details to identify a Manufacturer. The Buyer will not, directly or through anyone else, use Confidential Information to contact, buy from or contract with a supplier we identified to it in confidence for the products we supply, or to solicit a customer it learned of through us, during the relationship and for 12 months after its last order. This does not restrict dealing with anyone the Buyer already knew or finds on its own, and if any limit is found too broad it is narrowed to what is enforceable. The Buyer may give the batch lab results, as we provided them and including any redactions, to its own customers for the product it bought and may respond to a regulator or legal process. These duties last 3 years after the last order, and longer for trade secrets. We may seek an injunction without posting a bond and recover our costs and attorneys’ fees. A separate signed NDA controls if it conflicts with this Section.

Section 43. Order changes, cancellation, quotes and deposits

Cancellation is not guaranteed. The Buyer may change or cancel an accepted order only if we agree in writing before it ships, and we may condition our agreement on payment of costs we have incurred, including labor, materials, supplier and lab charges and processing fees, which are non-refundable. Once an order has shipped it cannot be canceled, and Sections 24 and 26 apply. For custom and private label orders, any deposit is non-refundable once we accept the order; it is credited to the price, and if the Buyer cancels or does not complete the order it forfeits the deposit and owes any unpaid balance for work done and materials ordered. We refund an unearned deposit only if we cancel before production starts for a reason other than the Buyer’s breach or non-payment. Product quotes are valid for 3 business days and shipping quotes for 7 business days, and any quote is void immediately if a law, regulation, enforcement position, or carrier or supplier restriction changes. A quote is not an offer. Shipping weights are approximate, and if actual shipping cost differs after acceptance the Buyer pays the actual cost. We may extend delivery dates or cancel any order in whole or in part for the reasons in Sections 27 and 28, and then our only obligation is to refund unearned amounts paid.

Section 44. Product conformity, storage and returns

Before shipment the Buyer may review the batch lab results and request in writing that we replace nonconforming product. The Manufacturer warrants only that a product conforms substantially to the lab results provided for its lot, within normal lab variance, and we pass that warranty through to the Buyer. We give no separate warranty. That limited warranty is void if the product has been altered, reprocessed, mixed or repackaged, or if the issue results from misuse, improper storage or handling, accident, or the act or omission of anyone other than the Manufacturer or us. The Buyer must store products as the label, lab results or industry practice directs and must inspect each shipment on receipt as the Shipping Policy requires. No product may be returned without our prior written authorization and a return authorization number. Returns must be prepaid, in original condition and packaging, and are credited only to the original purchaser, subject to the restocking fee in the Return Policy. Accepting delivery waives any claim for delay.

Section 45. Eligibility, text messages and app messages

The Buyer represents that the person ordering is at least 21 years old, or older where the law requires, and meets every legal requirement to buy the products. We may contact the Buyer by text message and messaging apps at a number the Buyer gives us. Service messages cover quotes, orders, shipping, account and support. We send marketing messages only after the Buyer separately opts in using a checkbox or form that is not pre-checked. Message frequency varies and message and data rates may apply. Reply STOP to stop messages or HELP for help. Consent to text messages is not a condition of buying. Carriers are not liable for delayed or undelivered messages.

Section 46. Our role as sales and collection agent

Agency sales. We sell products on behalf of the licensed manufacturers that make them or hold title to them (each a “Manufacturer”), as the Manufacturer’s sales and collection agent. The Manufacturer is the seller of the goods, and title passes from the Manufacturer to the Buyer under Section 22.

Our services. We market products, qualify Buyers, accept orders, collect payment for the Manufacturer, arrange shipping and handle support. We are responsible for our own services and statements as these Terms describe.

One point of contact. The Buyer deals only with us for ordering, payment, shipping, claims and support, whichever Manufacturer made the product.

Protections apply to both. Every limit, waiver, disclaimer, indemnity and risk allocation in these Terms protects both us and the Manufacturer, and either may enforce it (see also Section 30).

Section 47. Confidential manufacturers and redacted documents

Identity kept confidential. We do not disclose which Manufacturer makes a product. Invoices and order records may identify the Manufacturer by a code we assign, and the code is our Confidential Information under Section 42.

Redacted documents. Licenses, registrations, lab reports and specification sheets we share may have Manufacturer names, addresses, license numbers and other identifiers redacted. We never alter test results or other substantive content. The batch lab results for each order ship with the order.

Full documents. If the Buyer needs unredacted licenses, registrations or lab reports for its own compliance, we may provide them under a signed NDA and non-circumvention agreement, at our discretion.

Required disclosure. We disclose a Manufacturer’s identity to a court, regulator or law enforcement when legally required, including any state kratom program that requires it, and as needed to resolve a product claim, recall or Government Action.

Section 48. Manufacturer product terms and order of precedence

Two sets of terms. Each order is governed by these Terms and by the Manufacturer’s product terms for each product in it. Manufacturer product terms are available from us on request, with identifiers redacted. Different products in one order may carry different Manufacturer terms.

Which controls. If they conflict: (a) the Manufacturer’s terms control product specifications, composition, alkaloid content, quality, labeling and the Manufacturer’s warranty; (b) these Terms control everything else, including eligibility, ordering, payment, shipping, risk of loss, Government Action, cancellations, claims procedure and deadlines, remedies, liability limits, indemnities, confidentiality, non-circumvention, dispute resolution and governing law; and (c) where it is unclear, these Terms control.

No expansion of remedies. Nothing in a Manufacturer’s terms enlarges our liability or the Buyer’s remedies beyond Sections 26, 28 and 29.

Orders

Cancellation Policy

No order can be canceled or changed unless we agree in writing before it ships, and we may decline for any reason. We may condition our agreement on payment of costs we have incurred, including labor, materials, supplier and lab charges and processing fees, which are non-refundable. Once an order ships it cannot be canceled, and our Terms on shipment, risk of loss and final sale apply.

This policy covers cancellations for any reason and requests to change a shipping address. If a package is not delivered because of an inaccurate address the Buyer provided, Kratom. One is not responsible for a replacement, refund or credit. If we agree to cancel an unshipped order, we refund the amount paid less card, wire and processing fees and the costs described above. Deposits on custom and private label orders are non-refundable once we accept the order (Section 43).

Shipping

Shipping Policy

Kratom. One ships within the United States only, and only to addresses where our products can be lawfully delivered. Every ship-to address is reviewed against current state and local rules before an order is confirmed. Orders ship in plain packaging with no brand labeling, with the batch lab results for the lot. Lead time and freight are listed on your quote, and orders ship once payment is received. See also our shipping and returns overview.

Important details

  • Shipping timeframes. Lead times and transit times are estimates and are not guaranteed. They may change because of carrier delays, demand, supplier or lab timing, or verification.
  • Tracking and signature. Every order ships with tracking. We may require a signature, including adult signature where the carrier offers it, for higher-value orders. We do not change the shipping address after payment without written verification.
  • Proof of delivery. Carrier tracking showing delivery to the address on the order, with a signature where required, confirms delivery.
  • Shortages, errors and transit damage. If an order arrives short, incorrect or damaged, tell us within 7 days of the delivery date shown in tracking, with your order number and photos of the outer packaging, labels and affected product. We correct shortages and picking errors we confirm. Transit loss and damage are handled under this process for shipments insured under Section 32 of our Terms and for loss or damage we confirm in writing; for those, open a claim with the carrier and we provide the tracking and shipping details the carrier needs. This process does not apply to Government Action (Section 24).
  • Address and recipient. The Buyer must have someone authorized to accept delivery, including a signature where required. If a package is returned, refused or unclaimed, the Buyer pays all outbound and return freight, re-delivery, storage and carrier fees, and a 25% restocking fee applies to any refund we agree to give, less outbound shipping.
  • Unattended and redirected delivery. If the Buyer directs a carrier to leave a package unattended, hold it at a facility, forward it or redirect it, the Buyer bears all risk from that point, and Section 24 applies.
  • Inspection on receipt. The Buyer must inspect each shipment on arrival, note visible damage, tampering or shortage on the carrier’s delivery record, and photograph the sealed package, labels and contents before use or resale. Claims without photos, or made after the claim period, may be denied.
  • Delays. We are not liable for delay of any kind, including delay caused by weather, carrier restrictions, inspection, holds, Government Action, payment verification or supplier or lab timing. Delay does not let the Buyer cancel, refuse delivery or withhold payment.
  • Packaging and labeling. We or the Manufacturer choose packaging. We package and label shipments as required by law and by the carrier, and we do not misdescribe contents to any carrier or authority. Blind shipping means no brand labeling, not a false description. The Buyer must not ask us to ship under a false description.
  • Conflicts between policies. If this Shipping Policy, the Return Policy, the Cancellation Policy and our Terms conflict, the more specific provision controls.

Returns

Return Policy

We stand behind the quality of our products. All sales are final once an order ships, with the exceptions and conditions below, including a quality, weight or shortage claim we confirm in writing.

Consumable products and quality claims

  • Sold by lot. Kratom powder, crushed leaf, extracts, capsules, gummies and shots are sold by lot. The batch lab results for the lot are the product specification and ship with your order.
  • Quality claims. Notify us within 7 days of delivery with photos of the product, packaging and lot label, and send the written claim with supporting documents within 30 days of delivery. Keep the product as received until we respond. Product that matches its listing and its batch lab results, within normal lab variance, is as described. Natural variation in color, texture and aroma between lots is not a defect. If we confirm a quality issue, we replace the product, issue a credit or refund it, at our option.
  • Weight. Report any weight shortage within 7 days of delivery with a photo of the sealed package on a scale.
  • Opened products. Opened consumable products cannot be returned except under a confirmed quality claim.
  • Limited warranty. The only warranty is the Manufacturer’s limited warranty that the product matches its batch lab results. It is void if the product was altered, repackaged or stored improperly.

Returns of non-defective items

  • Eligibility. Unused, in 100% original, unopened packaging and resalable condition.
  • Authorization. No return is accepted without our prior written authorization and a return authorization number. Credit goes only to the original purchaser, and we may decline any return.
  • Notification. Notify us within 5 days of delivery of your intent to return.
  • Return period. Items must be received back within 10 days of delivery.
  • Restocking fee. A 25% restocking fee applies.
  • Shipping charges. Non-refundable. The value of outbound shipping is deducted from your refund.

Final sale items

Samples, test lots, custom orders and private label orders are final sale and cannot be returned for non-defective reasons (Section 27).

Unauthorized or refused returns

Unauthorized returns are refused. A shipment held, seized, detained or returned by a carrier or authority is not a quality or transit claim, and no refund or credit is owed (Section 24). Refused or undeliverable shipments incur a 25% restocking fee plus shipping charges. The quickest way to handle a problem is to accept delivery and then contact us.

Return instructions

  • Contact us first through the contact page for a return authorization number.
  • Requirements. Original, unopened packaging with all components and an unbroken seal.
  • Shipping. Fully insure the return and use a carrier with proof of delivery. Authorized returns must include a tracking number.

The Buyer is responsible for return shipping and handling. We are not responsible for lost, stolen or damaged return packages. Return shipments must comply with all carrier rules and laws that apply to kratom products.
