Kratom. One supplies wholesale kratom to Delaware businesses, shipped direct from US manufacturers. Since September 8, 2026, Delaware allows kratom sales only to people 21 and over and bans packaging and marketing that appeals to young people. The law sets no 7-OH cap yet, and a state report on testing and licensing is due January 1, 2027.

Short answer
Yes, to adults 21 and over. Delaware's new Kratom Consumer Protection Act (16 Del. C. ch. 30S, effective September 8, 2026) bars sale or marketing to anyone under 21 and bans youth-appealing design, but sets no 7-OH cap, label content rule, testing rule or license. A state report is due January 1, 2027. Kratom. One quotes six formats to Delaware businesses.
Delaware at a glance
The short version of what applies to a Delaware order. Full rules are on our Delaware law page.
Formats we quote for Delaware
Delaware names powders, capsules, gummies, shots and beverages in its definition, so packaging design matters more than the format itself.
Leaf powder for Delaware buyers
Plain leaf powder is the lowest-risk Delaware format. Keep package art free of cartoons, youth symbols and images of anyone who appears under 27.

Red Maeng Da

Green Maeng Da

White Maeng Da

Red Bali

Green Malay

White Borneo
Crushed leaf for Delaware buyers
Crushed leaf is covered by the same age and marketing rules as powder. The lot report is not required by the state, but it prepares you for the 2027 testing discussion.

Crushed Kratom Leaf
Capsules for Delaware buyers
Capsules are listed in the Delaware definition. The same 21 and over rule and youth-appeal limits apply to the carton and the bottle.

Red Vein Capsules

Green Vein Capsules

White Vein Capsules
Extracts for Delaware buyers
Delaware sets no potency cap today, but its coming report must address concentrated products and potency limits. We quote extracts against a lot report, and we never ship concentrated or isolated 7-OH products.

Kratom Extract Powder

Liquid Kratom Extract

Mitragynine Extract

High Purity Mitragynine
Gummies for Delaware buyers
Gummies are named in the definition. Review the artwork closely, since images of food aimed at children and mimicry of youth trademarks are barred.

Mixed Berry Gummies

Tropical Gummies

Watermelon Gummies
Shots for Delaware buyers
Shots and beverages are named in the definition and follow the same age rule. Check the label for youth-appealing imagery and for claims about intoxication.

Delaware order checklist
Five things to settle before you place a Delaware order, in the order they usually come up.
Check photo ID on every sale
Delaware makes checking a photo ID an affirmative defense to a sale-to-minor charge. Build the ID check into the counter routine so you can show it was done.
Audit packaging against the youth-appeal list
Cartoons, superheroes, video game references, child-oriented food images, mimicry of youth trademarks and images of a person who appears under 27 are barred. Review shelf art and ads before launch, not after.
Plan around age 27 in artwork
The enacted text says 27, not 21, in the image clause, and it is unclear whether that was intended. Until it is clarified, keep models and illustrated figures clearly adult.
Place product away from under-21s
Product may not be stored or displayed where non-employees under 21 can reach it. Decide the display location before the order arrives.
Start a lot report file now
The January 1, 2027 report must cover testing, concentrated 7-OH products and potency limits, so rules may follow in 2027. A file of lot reports now will make that transition easier.
Treat every form as covered
The definition reaches liquids, pills, capsules, tablets, powders, gummies, shots and beverages. Do not assume a gummy or shot falls outside the age and marketing rules.
Delaware compliance points for buyers
21 and over, with an ID defense
It is unlawful to sell, furnish or market kratom to anyone under 21, and checking a photo ID is an affirmative defense. Product also cannot be stored or displayed where non-employees under 21 can reach it.
Youth-appealing design is banned
Cartoons, superheroes, video game references, child-oriented food images, mimicry of youth trademarks and images of a person who appears under 27 are barred. The enacted text says 27 in the image clause, so plan around 27.
No cap, label mandate or testing rule yet
The enacted law has no 7-OH or mitragynine limit, no synthetic-alkaloid ban, no required label content and no testing rule. Provisions in the original bill were dropped, and the January 1, 2027 report may lead to 2027 bills.
Penalty and records
Sale or marketing to someone under 21 is a class B misdemeanor handled by police and prosecutors. Keep lot reports and age-check procedures on file so you are ready if testing or licensing rules follow.
Labels and records for Delaware
What the statute asks for on a package, and the records that let you stand behind it.
No required label content
Delaware prescribes no label elements for kratom. The rule that bites is on design: nothing on the package or label may appeal to young people.
Keep intoxication claims off the pack
The law treats claims about intoxication that would appeal to children as unlawful marketing to minors. Keep the label factual and limited to product identity and ingredients.
What changed and what to watch
- June 11, 2026
HS 1 for HB 332 replaced the original bill, leaving out provisions on synthetic compounds and 7-OH levels.
- August 26, 2026
DEA temporarily placed mitragynine pseudoindoxyl, MGM-15 and MGM-16 in Schedule I. We do not supply these compounds.
- September 8, 2026
HS 1 for HB 332 was signed and took effect (85 Del. Laws c. 478), setting the 21 and over rule and the marketing limits.
- October 14, 2026
DEA published a notice of intent on 7-OH and mitragynine pseudoindoxyl. An order cannot issue before about November 13, 2026.
Local rules inside Delaware
Local rules. No Delaware local kratom ordinance was confirmed in the research we reviewed, which is not the same as there being none. We check each ship-to address before quoting, and you should check city and county code too.
Delaware compared with nearby states
New Jersey
No kratom statute at all today; 7-OH Schedule I bills and a criminalizing bill, S829/A1617, are pending through the session that runs to January 2028.
Pennsylvania
No state kratom law either, but HB 2657 would require Department of Health registration, 21 and over and a 0.05% 7-OH dry-weight limit.
Virginia
More prescriptive: HB 360, in force since July 1, 2026, sets two 7-OH limits, required label text and a behind-the-counter rule.
Bulk kratom in Delaware FAQ
Does Kratom. One ship wholesale kratom to Delaware?
Yes, to business buyers. Orders ship direct from US manufacturers after we review the Delaware ship-to address against the new law.
Which kratom formats can a Delaware store order?
Leaf powder, crushed leaf, capsules, extracts, gummies and shots. The law names these forms in its definition and bans none, but the age and packaging rules apply to every one.
Does Delaware require lab reports or a license?
Not yet. There is no testing rule or license, but both are subjects of a state report due January 1, 2027. We make the lot report available now.
Does Kratom. One use the same 21 age as Delaware?
Yes. Delaware set 21 effective September 8, 2026, and we sell to adults 21 and over only in every state we serve.
Does Delaware cap 7-OH?
No. The enacted law has no 7-OH or mitragynine cap and no synthetic-alkaloid ban. The January 1, 2027 report must address potency limits, and we never ship concentrated or isolated 7-OH products.
Could Delaware change its kratom law again?
A 2026 felony ban bill did not advance. The January 1, 2027 report could lead to new bills, so we recheck this page after each session.
What is the penalty for selling to a minor in Delaware?
Sale or marketing to someone under 21 is a class B misdemeanor, and checking a photo ID is an affirmative defense. Confirm sentencing exposure with Delaware counsel.
