Yes. Maine has no kratom law, and kratom, mitragynine and 7-OH do not appear on the state's drug schedules. There is no state minimum age, no labeling or testing rule specific to kratom, and no seller registration. General food and drug law still applies, and federal action on 7-OH and semi-synthetic derivatives is moving fast.

What changed recently
- LD 1920 (P.L. 2025, c. 416) set an age of 21 for potentially intoxicating hemp products. Its text does not mention kratom, per a secondary source.
- A national survey of state kratom laws listed Maine as having no kratom statute and no recent kratom bill.
- Boston.com reported that Maine has no statewide kratom restriction, the same day Massachusetts announced its emergency order.
- Neighboring Massachusetts temporarily placed all kratom in Schedule I.
- Federal: DEA published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold, with an order expected on or after November 13, 2026.
- The 133rd Maine Legislature convenes. No kratom bill has been reported for it yet.
The Maine rules in detail
No state kratom law
Maine has not passed a kratom consumer protection act or any other kratom-specific statute. No kratom bill was found in the 132nd Legislature (2025-2026). That finding rests on two secondary surveys, because the research could not search the Legislature’s bill database directly.
Not on Maine's drug schedules
Maine’s controlled substance schedules (Schedules W, X, Y and Z in 17-A M.R.S. Sec. 1102) do not mention kratom, Mitragyna speciosa, mitragynine or 7-OH. One secondary source argues 7-OH could be treated as an opiate under Schedule W’s effect-based wording if a court agreed. No ruling or agency guidance takes that view.
What still applies
General federal and state food and drug law covers labeling, misbranding and adulteration. The Attorney General handles consumer protection. The Maine Board of Pharmacy has power to designate Schedule Z drugs, and no kratom designation was found. Many sellers choose an 18+ or 21+ policy on their own even though the state sets none.
The hemp age law does not reach kratom
Maine’s 2025 law setting 21 as the age for potentially intoxicating hemp products is sometimes cited in kratom discussions. Its text does not mention kratom, per the secondary source reviewed.
Federal changes to watch
Mitragynine pseudoindoxyl, MGM-15 and MGM-16 have been in federal Schedule I since August 26, 2026. DEA has also proposed temporary scheduling of 7-OH and mitragynine pseudoindoxyl above 1 mg/g in solids or 1 mg/mL in liquids. Federal rules apply in Maine whether or not the state acts. A lot-level lab report is how you show where a product falls.
Local rules inside Maine
We did not confirm any city or county kratom ordinances in Maine. That is not the same as there being none, so check the municipal and county code for every ship-to address.
Enforcement and penalties
No state agency enforces kratom rules in Maine because none exist, and state law has no kratom offense. Federally scheduled derivatives carry federal penalties. The research could not confirm any state penalty that would apply to ordinary kratom products, so ask Maine counsel if a product sits near a federal threshold.
Federal context
Federal rules sit on top of state law. As of the sources we reviewed on October 18, 2026, DEA had temporarily scheduled mitragynine pseudoindoxyl, MGM-15 and MGM-16 (effective August 26, 2026). On October 14, 2026 it published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold (more than 1 mg per gram or per mL, or less than 100 times as much mitragynine as 7-OH); that order cannot take effect before about November 13, 2026. DEA has said its action does not override stricter state law. Check the Federal Register for anything newer, and see our overview of kratom laws for sellers for the federal background.
Wholesale buyer checklist for Maine
- Set your own age policy for Maine buyers, since the state has none.
- Keep a lot-level lab report showing mitragynine and 7-OH for every product you ship to Maine.
- Drop any product containing mitragynine pseudoindoxyl, MGM-15 or MGM-16, which are federal Schedule I.
- Plan for the DEA 7-OH threshold if the order is published on or after November 13, 2026.
- Label to general food and drug standards and avoid health claims.
- Check town codes for each Maine ship-to address, since a full municipal search was not done.
- Watch the 133rd Legislature for a new kratom bill.
