How to buy wholesale kratom

Is Kratom Legal in Vermont?

No. Kratom is effectively banned in Vermont. The Department of Health's Regulated Drug Rule lists mitragynine and 7-hydroxymitragynine as hallucinogenic regulated drugs, so possessing or selling them is a crime under 18 V.S.A. s. 4235. There is no lawful market, and the 2025-2026 bills to regulate kratom never left committee.

The Vermont rules in detail

How the ban works

Vermont law defines hallucinogenic drugs to include any substance the Department of Health designates by rule as habit-forming or as having serious abuse potential (18 V.S.A. s. 4201). Section 7.0 of the Department’s Regulated Drug Rule lists mitragynine and 7-hydroxymitragynine. That makes kratom’s main alkaloids regulated drugs in any amount, with no exception for leaf.

Criminal penalties

Under 18 V.S.A. s. 4235, possession of a hallucinogenic drug carries up to 1 year and/or a $2,000 fine at the base level, with higher tiers for 10, 100 and 1,000 or more doses. Dispensing carries up to 3 years and/or $25,000, and selling up to 5 years and/or $25,000, rising with dose counts. The rule does not appear to set a dose for mitragynine, so it is unclear how the dose tiers apply to kratom.

What the failed bills would have done

H.416 would have created a regulated market with an under-21 limit, a 2% 7-OH cap, a ban on synthetic mitragynine and 7-OH, required labels, and a Department of Health product registry. S.121 carried the same title. Neither got a committee vote, and earlier bills in 2021-2022 and 2023-2024 also died. None of their terms are law.

What could change

No Department of Health proposed rule affecting kratom was found. A new legislature convenes in January 2027, and new regulation bills could be filed for the 2027-2028 biennium.

Enforcement and penalties

The Department of Health designates regulated drugs by rule. Criminal enforcement falls to state and local police, State’s Attorneys and the Attorney General under 18 V.S.A. ch. 84. No guidance was found that treats plain kratom leaf differently from extracts, so assume any product with mitragynine is covered and talk to Vermont counsel.

Federal context

Federal rules sit on top of state law. As of the sources we reviewed on October 18, 2026, DEA had temporarily scheduled mitragynine pseudoindoxyl, MGM-15 and MGM-16 (effective August 26, 2026). On October 14, 2026 it published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold (more than 1 mg per gram or per mL, or less than 100 times as much mitragynine as 7-OH); that order cannot take effect before about November 13, 2026. DEA has said its action does not override stricter state law. Check the Federal Register for anything newer, and see our overview of kratom laws for sellers for the federal background.

What this means for sellers

  1. Do not ship any kratom product to a Vermont address, including leaf, powder and capsules.
  2. Block Vermont ship-to addresses at checkout and in wholesale order review.
  3. Tell distributor and drop-ship partners that Vermont is excluded.
  4. Get Vermont counsel before any activity that touches the state.
  5. Recheck Vermont after the 2027 session for any new regulation bill or rule change.

Kratom. One does not accept orders shipping to Vermont. If you sell in other states, tell us your ship-to states and we will review them before quoting.

How we verified this page

We checked the sources below on October 18, 2026. Where a primary source (a statute, bill text or agency release) was available we relied on it, and we say so when a detail comes from news coverage or a secondary summary.

  • When mitragynine and 7-OH were first added to the Regulated Drug Rule. It is often cited as 2016 but was not confirmed.
  • Whether the July 15, 2019 rule posted by the Department is the latest adopted version.
  • How dose-based penalty tiers apply to kratom, since the rule sets no mitragynine dose.
  • Whether enforcement practice or any Attorney General guidance treats kratom leaf differently.
  • Whether new kratom bills will be filed in the 2027-2028 biennium.
