How to buy wholesale kratom

Is Kratom Legal in Hawaii?

Yes, with limits. Kratom leaf and mitragynine are legal in Hawaii, and the state has no kratom age, label, testing or registration law. Since September 22, 2026, though, an emergency order puts 7-OH above a low threshold in Schedule I, along with MP, MGM-15 and MGM-16. For extracts, edibles and pressed pills, the cap is 0.050% 7-OH or 1.00 mg per article, which likely captures most concentrated products. The order lapses unless the 2027 Legislature enacts it.

What changed recently

  1. HB 717 and SB 463, the Hawaii Kratom Consumer Protection Act bills, were introduced and later carried over to 2026.
  2. Act 107 (SB 1452) updated chapter 329 to match federal schedules. It added no kratom compound, per a secondary source.
  3. Hawaii's first reported 7-OH death occurred in Honolulu.
  4. The Department of Health warned the public about 7-OH and said it was evaluating regulatory and enforcement options.
  5. HB 717 and SB 463 did not pass and died when the session ended.
  6. The Narcotics Enforcement Division's emergency scheduling order took effect, adding 7-OH above a threshold, MP, MGM-15 and MGM-16 to Schedule I.
  7. Federal: DEA published a notice of intent to temporarily schedule 7-OH and MP using a different threshold than Hawaii's.
  8. The 2027 regular session convenes. The emergency listings are nullified if it does not enact them.

The Hawaii rules in detail

The 7-OH threshold

The emergency order lists 7-OH, including its isomers, esters, ethers and salts, in Schedule I when a product is over the threshold:

  • Kratom plant material: more than 0.050% 7-OH on a dry weight basis.
  • Extracts, concentrates, processed edibles, pressed pills, or any synthetic article: more than 0.050% 7-OH, or more than 1.00 mg of 7-OH in the article.

The order does not say whether “in the article” means per unit, per package or per serving. For a multi-serving extract, that difference matters a great deal. Until it is clarified, read it the strict way and ask Hawaii counsel.

Compounds banned at any amount

Mitragynine pseudoindoxyl (MP), MGM-15 and MGM-16 are Schedule I in Hawaii with no threshold. They are also federal Schedule I by DEA temporary order from August 26, 2026.

The order is temporary

The Department of Law Enforcement used its emergency power under HRS 329-11(e). That control is nullified if the next regular session, in 2027, does not enact matching changes to chapter 329. The research also flags a procedural question: the statute calls for 30 days of public notice before an effective date, but the order was posted and took effect the same day. Whether earlier notice was given is unknown.

No kratom consumer-protection law

Hawaii has no kratom minimum age, label rule, testing rule or product registration. HB 717 and SB 463 would have added Department of Health registration, warning labels, alkaloid limits and contaminant testing, but neither passed. A news outlet that bought 7-OH gummies in April 2026 reported no age check at the counter.

Testing in practice

No law requires testing. Still, you cannot show a leaf lot is under 0.050% 7-OH, or that an extract is under the per-article limit, without a lab report. Ask your lab for percent of dry weight on leaf and both percent and milligrams per unit on extracts. See how to read a kratom lab report.

Local rules inside Hawaii

We did not confirm any city or county kratom ordinances in Hawaii. That is not the same as there being none, so check the municipal and county code for every ship-to address.

Enforcement and penalties

The Narcotics Enforcement Division, county police and county prosecutors enforce controlled-substance law. A secondary source says 7-OH above the threshold falls under Hawaii’s promoting-a-dangerous-drug offenses (HRS 712-1240 to 712-1243). The research could not retrieve the primary penalty text, so it could not confirm offense levels or sentences. Treat any over-threshold product as a serious criminal risk and ask Hawaii counsel. The Department of Health has said it is evaluating its own options.

Federal context

Federal rules sit on top of state law. As of the sources we reviewed on October 18, 2026, DEA had temporarily scheduled mitragynine pseudoindoxyl, MGM-15 and MGM-16 (effective August 26, 2026). On October 14, 2026 it published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold (more than 1 mg per gram or per mL, or less than 100 times as much mitragynine as 7-OH); that order cannot take effect before about November 13, 2026. DEA has said its action does not override stricter state law. Check the Federal Register for anything newer, and see our overview of kratom laws for sellers for the federal background.

Wholesale buyer checklist for Hawaii

  1. Stop shipping 7-OH tablets, shots, gummies and concentrated extracts to Hawaii.
  2. Get a lot-level lab report showing every leaf lot at 0.050% 7-OH dry weight or less.
  3. For any extract or processed product, confirm 7-OH is at 0.050% or less and 1.00 mg or less per unit, package and serving.
  4. Confirm no product contains MP, MGM-15 or MGM-16.
  5. Set your own 21-and-over age gate, since Hawaii law sets none.
  6. Ask Hawaii counsel how the per-article limit applies to your multi-serving products.
  7. Recheck after the 2027 session, when the order must be enacted or it lapses.

Hawaii kratom law FAQ

Is kratom legal in Hawaii?

Kratom leaf and mitragynine are legal, but since September 22, 2026 an emergency order puts 7-OH above a low threshold in Schedule I. Hawaii has no kratom consumer-protection law.

What is the minimum age to buy kratom in Hawaii?

Hawaii law sets no minimum age for kratom. Bills that would have set rules did not pass.

What is Hawaii's 7-OH limit?

Leaf may not exceed 0.050% 7-OH by dry weight. Extracts, edibles, pressed pills and synthetic articles may not exceed 0.050% or 1.00 mg of 7-OH in the article.

Does Hawaii require a license or lab testing for kratom?

No. There is no license, registration or testing rule, but lab reports are the only practical way to show a product is under the 7-OH threshold.

Is Hawaii's 7-OH ban permanent?

No. It is an emergency order that is nullified unless the 2027 Legislature enacts it.

How we verified this page

We checked the sources below on October 18, 2026. Where a primary source (a statute, bill text or agency release) was available we relied on it, and we say so when a detail comes from news coverage or a secondary summary.

What we have not confirmed yet
  • Whether the order is procedurally valid, since it took effect the day it was posted despite a 30-day notice rule.
  • Whether the 1.00 mg limit applies per unit, per package or per serving.
  • Whether a bill to make the emergency listings permanent will be filed and pass in 2027.
  • The primary text of the penalty statutes (HRS 712-1240 to 712-1243) and the dangerous-drug definition.
  • Whether the Department of Health will issue any rule on kratom or 7-OH sales.
  • Whether HB 2321 HD1 and SB 3141 (2026) touched any kratom compound.
  • Whether any county has a kratom ordinance; none was found.
