Yes. Kratom is legal in Montana, and the state has no kratom-specific law as of October 18, 2026. There is no statewide minimum age, label rule, testing rule or license. That may not last: in August 2026 an interim committee voted 6-5 to send the 2027 Legislature a draft bill that would ban kratom statewide.

What changed recently
- Several kratom regulation bills were considered and none passed. HJ 60, a resolution ordering an interim study of kratom, did pass.
- The Law and Justice Interim Committee heard an NCSL briefing on kratom and 7-OH policy options. No bill was proposed then.
- The Economic Affairs Interim Committee voted 6-5 to advance a draft bill that would ban kratom by making its compounds controlled substances.
- The Law and Justice Interim Committee tabled a Kratom Consumer Protection Act draft by a vote of 8-1.
- Deadline for the HJ 60 study to conclude, with findings due to the 2027 Legislature.
- Federal: DEA published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a set threshold. The order cannot issue before November 13, 2026.
The Montana rules in detail
No state kratom law
Montana has no statute or rule written for kratom or 7-OH. That means no state minimum age, no label content, no testing, no alkaloid cap and no seller license. This finding rests on consistent news reports; a primary search of Montana code did not separately confirm it.
What still applies
Federal law applies in Montana. Mitragynine pseudoindoxyl, MGM-15 and MGM-16 have been temporary Schedule I substances since August 26, 2026. DEA’s October 2026 notice covers 7-OH and mitragynine pseudoindoxyl above 1 mg/g in solids or 1 mg/mL in liquids, or a mitragynine-to-7-OH ratio under 100. Whether Montana’s own drug schedules will mirror these federal actions is not known.
We found no Montana city or county kratom ordinance, but local rules were not searched in depth.
The 2027 ban draft
The Economic Affairs Interim Committee’s draft would prohibit kratom statewide by classifying its chemical compounds as controlled substances. The bill draft number and text were not available. It is not clear whether the ban would reach natural leaf or only certain alkaloids such as 7-OH. Reports say at least one other ban proposal is moving through another committee.
The regulation draft that was tabled
The Law and Justice Interim Committee set aside a Kratom Consumer Protection Act draft. It would have banned synthesized kratom, required labels, and added state oversight and testing, with an 18+ age limit. Members tabled it partly because they felt it was too weak, and some pushed for an age of 21. For how other states regulate kratom, see kratom laws by state.
Local rules inside Montana
We did not confirm any city or county kratom ordinances in Montana. That is not the same as there being none, so check the municipal and county code for every ship-to address.
Enforcement and penalties
With no state kratom statute, there are no state kratom penalties. Federal FDA authority applies to kratom sold for human use. If Montana passes a law in 2027, the Department of Justice or the Department of Public Health and Human Services may enforce it, but that was not confirmed.
Federal context
Federal rules sit on top of state law. As of the sources we reviewed on October 18, 2026, DEA had temporarily scheduled mitragynine pseudoindoxyl, MGM-15 and MGM-16 (effective August 26, 2026). On October 14, 2026 it published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold (more than 1 mg per gram or per mL, or less than 100 times as much mitragynine as 7-OH); that order cannot take effect before about November 13, 2026. DEA has said its action does not override stricter state law. Check the Federal Register for anything newer, and see our overview of kratom laws for sellers for the federal background.
Wholesale buyer checklist for Montana
- Pull any product containing mitragynine pseudoindoxyl, MGM-15 or MGM-16, which are federal Schedule I substances.
- Keep lot-level lab reports for 7-OH and mitragynine so you can compare each product to the federal threshold. See how to read a kratom lab report.
- Avoid synthesized or concentrated 7-OH products, which drew the most concern in the interim hearings.
- Consider a 21+ sales policy, since legislators reviewing the tabled draft pushed for 21.
- Keep Montana inventory and contract commitments short until the 2027 session outcome is clear.
- Track the ban draft and any other kratom bills once the Legislature convenes in January 2027.
