How to buy wholesale kratom

Is Kratom Legal in Delaware?

Yes. Kratom is legal in Delaware, and since September 8, 2026 it may only be sold, furnished or marketed to people 21 and over. The new Kratom Consumer Protection Act (16 Del. C. ch. 30S) also bans packaging and marketing that appeals to young people. It sets no 7-OH cap, label content rule, testing rule or license, but a state report on testing and retail licensing is due January 1, 2027.

What changed recently

  1. SB 262 was introduced. It would have made manufacturing or selling kratom products a class C felony.
  2. HB 332 was introduced to regulate kratom.
  3. SS 1 for SB 262 replaced the ban bill and dropped simple-possession charges. It stayed in Senate Health and Social Services.
  4. HS 1 for HB 332 replaced the original HB 332. Provisions on synthetic compounds and 7-OH levels were left out.
  5. The 153rd General Assembly ended. SS 1 for SB 262 had no further action and appears to have died.
  6. HS 1 for HB 332 was signed and took effect (85 Del. Laws c. 478).
  7. Federal: DEA published a notice of intent to temporarily schedule 7-OH and MP above a threshold.
  8. A state report on kratom testing and retail licensing is due.

The Delaware rules in detail

Who you can sell to

It is unlawful to sell, furnish or market kratom or kratom products to anyone under 21. Checking a photo ID is an affirmative defense, so card every buyer who could be under 21. Products also may not be stored or displayed where non-employees under 21 can reach them.

Marketing and packaging limits

The law treats youth-appealing design as unlawful marketing to minors. Keep these off packages, labels and ads:

  • Cartoons, superheroes and video game references.
  • Images of food aimed at children.
  • Trademarks that mimic youth products, and youth symbols or celebrities.
  • Images of a person who appears to be under 27.
  • Claims about intoxication that would appeal to children.

The enacted text says 27, not 21, in the image clause. It is not clear whether that was intended, so plan around 27 until it is clarified.

What counts as a kratom product

The definition is broad. It covers any consumable form that contains kratom, a kratom alkaloid, or a substance made to mimic one: liquids, pills, capsules, tablets, powders, gummies, shots and beverages. That means 7-OH products fall under the same age and marketing rules as leaf powder.

No 7-OH cap, label mandate or testing rule yet

Delaware has no limit on 7-OH or mitragynine and no ban on synthetic alkaloids. The original HB 332 reportedly had those provisions, but the enacted substitute dropped them. There is also no required label content and no testing rule.

That may change. The state report due January 1, 2027 must cover testing, concentrated 7-OH products and potency-based limits, and it is the likely basis for 2027 bills. Lot-level lab reports now will make that transition easier. See how to read a kratom lab report.

Licensing

No state license or registration exists for kratom vendors, makers or retailers. The Division of Alcohol and Tobacco Enforcement, working with two DHSS divisions, must recommend whether to create retail licensing, compliance checks and administrative penalties.

Local rules inside Delaware

We did not confirm any city or county kratom ordinances in Delaware. That is not the same as there being none, so check the municipal and county code for every ship-to address.

Enforcement and penalties

The statute does not name a regulator. Sale or marketing to someone under 21 is a class B misdemeanor, handled by police and prosecutors in the courts. Under Delaware’s general sentencing law (11 Del. C. s. 4206(b)), a class B misdemeanor carries up to 6 months of Level V incarceration and a fine of up to $1,150. The law has no civil or administrative penalties.

Federal context

Federal rules sit on top of state law. As of the sources we reviewed on October 18, 2026, DEA had temporarily scheduled mitragynine pseudoindoxyl, MGM-15 and MGM-16 (effective August 26, 2026). On October 14, 2026 it published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold (more than 1 mg per gram or per mL, or less than 100 times as much mitragynine as 7-OH); that order cannot take effect before about November 13, 2026. DEA has said its action does not override stricter state law. Check the Federal Register for anything newer, and see our overview of kratom laws for sellers for the federal background.

  4. Remove any intoxication claims that could appeal to children.
  5. Treat 7-OH gummies, shots and tablets as covered kratom products under the age and marketing rules.
  6. Keep lot-level lab reports on file ahead of likely 2027 testing and potency rules.
  7. Watch for the January 1, 2027 state report and any bills that follow it.
