Yes, for now. Michigan has no kratom law, so the state sets no age limit, 7-OH cap, label rule or seller license. That could change: HB 5537, which would ban production and sale of kratom, passed the House 56-48 on March 18, 2026 and is waiting in the Senate. Some cities, including St. Clair Shores, have adopted their own age-21 rules.

The Michigan rules in detail
No state kratom law yet
Michigan has not enacted any kratom statute. The state sets no minimum age, no 7-OH or mitragynine limit, no labeling or testing rule and no registration. General food and drug misbranding law still applies, and so do federal rules on scheduled kratom derivatives.
What HB 5537 would do
HB 5537 would add MCL 750.473a to the Penal Code and ban the production and sale of kratom. News reports describe the definition as any product containing any part of Mitragyna speciosa, including extracts, derivatives and synthetic variants. Reports say sales to minors would draw heavier punishment, up to 1 year in jail. The research did not review the H-1 bill text, so exact penalties, possession rules and exceptions are unconfirmed.
Timing of a possible ban
The House gave HB 5537 immediate effect. If the Senate also grants immediate effect, the ban could start on signing, but that is not confirmed. Sen. Ed McBroom was meeting with Upper Peninsula businesses before any vote. If the Senate does not act by December 31, 2026, the bill dies.
Federal derivatives and 7-OH
Mitragynine pseudoindoxyl, MGM-15 and MGM-16 have been federal Schedule I since August 26, 2026. DEA has also proposed temporary scheduling of 7-OH and mitragynine pseudoindoxyl above 1 mg/g in solids or 1 mg/mL in liquids, with an order expected on or after November 13, 2026. Lot-level lab reports show where each product stands.
Local rules inside Michigan
State law is not the whole picture. Cities and counties can add their own rules, and some already have.
- St. Clair Shores. Ordinance adopted 6-0 on April 20, 2026. Sale to anyone under 21 is a misdemeanor; purchase, possession or use by a minor is a civil infraction. Enforced by St. Clair Shores Police. Fine amounts were not confirmed.
- Other southeast Michigan communities. Local reporting says many have adopted or are weighing kratom rules, but they were not named. No outright city ban was confirmed.
Enforcement and penalties
No state agency enforces kratom rules today because Michigan has none. Local police enforce city ordinances such as the St. Clair Shores age rule. If HB 5537 becomes law, local prosecutors and police would enforce it under the Penal Code. The research could not confirm the bill’s penalty amounts, so ask Michigan counsel before relying on any figure.
Federal context
Federal rules sit on top of state law. As of the sources we reviewed on October 18, 2026, DEA had temporarily scheduled mitragynine pseudoindoxyl, MGM-15 and MGM-16 (effective August 26, 2026). On October 14, 2026 it published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold (more than 1 mg per gram or per mL, or less than 100 times as much mitragynine as 7-OH); that order cannot take effect before about November 13, 2026. DEA has said its action does not override stricter state law. Check the Federal Register for anything newer, and see our overview of kratom laws for sellers for the federal background.

- Drop any product with mitragynine pseudoindoxyl, MGM-15 or MGM-16, which are federal Schedule I.
- Label to general food and drug standards and avoid health claims.
