Is Kratom Legal in Florida?

Kratom products are lawful but regulated in Florida: sale to anyone under 21 is a misdemeanor, and FDACS rules require 7-OH to be declared on the label. Separately, a June 22, 2026 Attorney General emergency rule placed 7-OH and six related compounds in Schedule I, with a 1 mg per gram cap and a requirement of at least 100 times more mitragynine. The legislature did not codify those limits.

The Florida rules in detail

Age limit

Section 500.92 bars selling or delivering a kratom product to anyone under 21. A violation is a second-degree misdemeanor. FDACS enforces the section.

The FDACS label rule

FDACS emergency rules require the 7-OH concentration, including its isomers, esters, ethers and salts, to be declared on the label in parts per million on a dry-weight basis. The amended rule lets a product state a detection limit if 7-OH is below the method detection limit and the quantitation limit is under 400 ppm. We could not retrieve the full text of Rule 5K-4.030, so other label content rules are unconfirmed.

The Attorney General emergency rule on 7-OH

Under the June 22, 2026 rule, 7-OH and six related compounds are Schedule I: mitragynine pseudoindoxyl, 7-acetoxymitragynine, 9-hydroxycorynantheidine, 10-hydroxycorynantheidine, MGM-15 and MGM-16. Products may contain them only under a cap of 1 mg per gram of solid or per mL of liquid, and only with at least 100 times more mitragynine by mass. The Attorney General has described the consequences as felony charges.

Emergency rules in Florida are time-limited, and the expiration of the June 2026 rule is not stated in the sources we reviewed. Earlier press coverage also reported different thresholds, such as 0.04%, so confirm which rule is in force when you ship.

Testing and licensing

We did not find a statutory testing mandate or a kratom license. The label rule effectively requires a lab method that can quantify 7-OH, so lot-level reports are a practical necessity. Whether a wholesale kratom operation needs an FDACS food permit is unconfirmed.

Local rules inside Florida

We did not confirm any city or county kratom ordinances in Florida. That is not the same as there being none, so check the municipal and county code for every ship-to address.

Enforcement and penalties

FDACS enforces the labeling and age rules, and its Division of Food Safety inspectors have removed products from shelves. The Attorney General’s Office and law enforcement handle Schedule I conduct. Violations of Rule 5K-4.030 are penalized under subsection (5) of that rule, whose text we could not retrieve.

Federal context

Federal rules sit on top of state law. As of the sources we reviewed on October 18, 2026, DEA had temporarily scheduled mitragynine pseudoindoxyl, MGM-15 and MGM-16 (effective August 26, 2026). On October 14, 2026 it published a notice of intent to temporarily schedule 7-OH and mitragynine pseudoindoxyl above a threshold (more than 1 mg per gram or per mL, or less than 100 times as much mitragynine as 7-OH); that order cannot take effect before about November 13, 2026. DEA has said its action does not override stricter state law. Check the Federal Register for anything newer, and see our overview of kratom laws for sellers for the federal background.

Florida kratom law FAQ

21. Selling or delivering to anyone younger is a second-degree misdemeanor.

What does the Florida 7-OH rule say?
